Terms and Conditions for Authorized Users of the Joslin Insight App

1. Introduction
Welcome to the Joslin Insight App, a mobile application provided by Joslin Insight, Inc. (“Joslin Insight”) designed to collect anonymous employee feedback in real-time for reporting to organizational leadership. By using this app, you agree to the following terms and conditions.
2. Authorized Users
2.1 Eligibility: Only active employees of the organization or individuals listed in the CSV file provided by the organization are authorized to use the Joslin Insight App.
2.2 Voluntary Participation: Participation in providing feedback through the app is entirely voluntary. There are no negative consequences for choosing not to participate.
2.3 Incentives: Any incentives for participation are offered at the discretion of the organization and are not guaranteed by Joslin Insight.
2.4 Non-Transferability: Authorized users must not transfer or grant access to the app to any other individual.
3. Data Collection and Use
3.1 Anonymous Feedback: All feedback provided through the app remains anonymous unless you choose to de-anonymize your response or self-identify.
3.2 Data Use: Data collected is used solely for reporting to organizational leadership and for aggregate, de-anonymized benchmarking purposes. Joslin Insight will not sell or share data with third parties.
3.3 PII Storage: Personally Identifiable Information (PII) such as Name, Work Email, Role, and Department may be collected for user management purposes. Voluntarily provided data elements like Gender, DOB, and work tenure may also be stored.
4. Security
4.1 Data Security: All data is anonymized before transit, processed, and stored securely on ISO 27001, ISO 27017, or ISO 27018 certified Google Cloud servers located in the United States.
4.2 Encryption: Data at rest is encrypted using AES-256, and data in transit is encrypted using TLS 1.3.
4.3 Access Control: Authorized User accounts are provisioned through secure invite links or authorized via the user management panel. Only the customer and its authorized users have access to the cloud service.
4.4 Audit and Monitoring: Joslin Insight enforces detailed audit logging for access or changes to sensitive data and conducts regular security audits and vulnerability testing.
5. Acceptable Use Policy
5.1 Prohibited Conduct: Users must not:
– Disassemble, decompile, reverse-engineer, copy, translate or create derivative works from the app.
– Transmit any content or data that is unlawful, harmful, or infringes on intellectual property rights.
– Engage in any behavior that could harm the operation or security of the app.
5.2 Violence and Harm: Submission of feedback that promotes violence, harm, or any form of abuse is strictly forbidden.
6. Account Security
6.1 Password Requirements: Passwords must be at least 8 characters long, including one uppercase letter, one lowercase letter, and one number. Weak passwords are not allowed.
6.2 Account Lockout: Accounts will be locked after multiple failed login attempts to prevent unauthorized access.
7. Support and Maintenance
7.1 Provisioning and Support: Joslin Insight provides access to the app and support as described in the order form. Maintenance is typically scheduled during low usage hours, but Joslin Insight will not notify users in advance.
7.2 Modifications: The app may be modified to include new features or updates.
8. Termination
8.1 Termination by User: Users may choose to stop using the app at any time without any penalty.
8.2 Termination by Joslin Insight: Joslin Insight reserves the right to suspend or terminate access to the app if continued use may result in material harm to the service or its users.
9. Liability
9.1 Disclaimer of Warranties: Except as expressly provided, Joslin Insight disclaims all warranties regarding the app, including the merchantability, suitability, or fitness for a particular purpose.
9.2 Limitation of Liability: By agreeing to these terms, the user acknowledges that they have read the terms and will not hold Joslin Insight liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use the app.
10. Miscellaneous
10.1 Governing Law: These terms and conditions are governed by the laws of the Commonwealth of Virginia, USA.
10.2 Changes to Terms: Joslin Insight may update these terms and conditions periodically. Users will be notified of any significant changes.
10.3 Order Form Precedence: In the event these terms and conditions conflict with the Order Form, the Order Form will take precedence.
